When is VAT registration required in Hungary for foreign companies?
Foreign companies operating in Hungary may be required to register for VAT (Value Added Tax) even without having a physical presence in the country. Common scenarios that cause a VAT registration obligation include:
- Distance sales to Hungarian private individuals above the EU threshold (yearly EUR 10,000);
- Importation of goods into Hungary;
- Intra-community acquisitions or supplies involving Hungarian warehouses;
- Provision of certain services to Hungarian non-VAT payer customers with a place of performance in Hungary;
- Holding inventory in Hungary or operating through a permanent establishment.
What is the risk of failing the VAT compliance?
Failing or delaying the VAT registration may lead to a default penalty up to HUF 1 million (cca EUR 2,500) and the Hungarian Tax Authority could levy a default penalty up to HUF 2 million (cca EUR 5,000) for the failure of invoice issuance liability.
Any tax discrepancy discovered during an audit that has not been paid by the due date qualifies as a tax shortfall. A tax penalty of 50% may be imposed (or 200% if the shortfall is related to income concealment, the preparation or use of false receipts, records, or books, or their falsification or shredding) after a tax shortfall. In addition a late payment interest may be charged from the original due date up to the date of the audit minutes, but for no more than three years. This interest is calculated daily based on the central bank’s base rate (currently 6.5%) plus five percentage points, divided by 365.
